Otter products Wereldwijde verklaring inzake moderne slavernij 2025

Inleiding

Deze Wereldwijde Verklaring inzake Moderne Slavernij 2025 (deze “Verklaring”) is opgesteld door Otter Products, LLC, namens zichzelf en haar gelieerde ondernemingen en dochterondernemingen, waaronder, maar niet beperkt tot, Otter Products EMEA Unlimited Company en Otter Products UK Limited (gezamenlijk “Otter”). Otter zet zich in om haar processen te verbeteren ter voorkoming van alle vormen van moderne slavernij, met inbegrip van, maar niet beperkt tot, mensenhandel, dwangarbeid, schuldslavernij en kinderarbeid (gezamenlijk “Moderne Slavernij”), binnen haar bedrijfsactiviteiten en toeleveringsketens. Deze Verklaring beschrijft de aanpak en acties van Otter om deze toezegging na te komen.

Organisatiestructuur en activiteiten

Otter bestaat uit een wereldwijde groep bedrijven in de consumentenelektronicasector die (onder andere) accessoires voor mobiele apparaten ontwerpen, inkopen, verpakken en distribueren. Met activiteiten in Noord-Amerika, Europa, het Midden-Oosten, Afrika en Azië heeft Otter zich gevestigd als een wereldwijde vernieuwer van hoogwaardige beschermende producten voor smartphones en tablets. Onze toeleveringsketens

Otter maakt gebruik van een wereldwijde toeleveringsketen en een omnichannel distributienetwerk om haar producten te leveren.

Governance inzake Moderne Slavernij

Otter zet zich in voor een toeleveringsketen die vrij is van Moderne Slavernij. Otter heeft een robuust beleid om Moderne Slavernij in haar bedrijf en toeleveringsketens te voorkomen en te veroordelen, waaronder het volgende:

  1. Momenteel houdt Otter zich aan de Responsible Business Alliance-gedragscode (de “RBA-gedragscode”). De RBA-gedragscode vereist dat Tier 1-leveranciers van Otter zich niet inlaten met Moderne Slavernij of deze ondersteunen. Daarnaast eist de RBA-gedragscode van leveranciers dat ze arbeidsvoorwaarden hanteren die voldoen aan de lokale wetgeving en die mensenrechten, fatsoen en passende arbeidsnormen garanderen. Deze normen omvatten vereisten op het gebied van arbeid, gezondheid, veiligheid, milieu, ethiek en management. Otter is van plan om tegen het einde van 2025 over te stappen op de Ethical Trading Initiative Base Code (de “ETI-gedragscode”) of een vergelijkbare reeks strenge normen. De ETI-gedragscode, gebaseerd op de conventies van de Internationale Arbeidsorganisatie, beschrijft wereldwijd aanvaarde arbeidsnormen om ethische arbeidsomstandigheden binnen toeleveringsketens te garanderen. De ETI-gedragscode omvat negen belangrijke gebieden, waaronder vrij gekozen werk, vrijheid van vereniging, veilige werkomstandigheden, verbod op kinderarbeid, leefbare lonen, redelijke werktijden, non-discriminatie, reguliere tewerkstelling en een verbod op wrede behandeling. Deze overgang bevestigt het streven van Otter om Moderne Slavernij uit te bannen en een verantwoorde en rechtvaardige werkomgeving te bevorderen. In de rest van deze Verklaring wordt de term “Gedragscode” gebruikt om te verwijzen naar de op dat moment geldende gedragscode, die zowel de RBA-gedragscode als de ETI-gedragscode kan zijn.
  2. De deskundigen van Otter zien toe op de naleving van de voorschriften door de leveranciers door middel van regelmatige audits door derden, om te waarborgen dat aan de eisen van Otter wordt voldaan.
  3. Otter veroordeelt alle vormen van Moderne Slavernij.
  4. Otter eist dat alle personen binnen de eigen organisatie en binnen de organisaties van haar leveranciers met respect en waardigheid worden behandeld, vrij zijn van discriminatie of intimidatie en een veilige werkomgeving hebben. Otter stelt middelen ter beschikking om schendingen van haar beleid te melden. Daarnaast biedt Otter haar medewerkers trainingen aan om ervoor te zorgen dat ze begrijpen hoe ze een werkplek zonder discriminatie en intimidatie kunnen handhaven. Deze maatregelen illustreren het streven van Otter naar een verantwoorde en ethische werkomgeving voor al haar activiteiten en toeleveringsketens.
  5. Het veiligheidsbeleid van Otter bevestigt dat de gezondheid en veiligheid van haar mensen een van haar topprioriteiten is en versterkt het streven naar een veilige werkplek waar iedereen optimaal kan werken. Otter verwacht van haar zakenpartners dat zij zorgen voor een veilige werkplek die voldoet aan alle lokale gezondheids- en veiligheidswetgeving en dat zij de beste methoden toepassen om het aantal ongevallen en verwondingen op de werkplek te verminderen.

Verantwoorde inkoop van mineralen

Otter erkent dat conflictmineralen vaak in verband worden gebracht met gevallen van Moderne Slavernij. Otter is toegewijd aan het naleven van ethische principes en maatschappelijke verantwoordelijkheid en sluit zich aan bij de wetten die onethische praktijken bestrijden in conflictgebieden en gebieden met een hoog risico, waaronder de Democratische Republiek Congo. Otter streeft ernaar te voldoen aan de regelgeving voor conflictmineralen en samen te werken met haar leveranciers om op verantwoorde wijze materialen en onderdelen in te kopen. Otter eist transparantie en verantwoorde inkoopmethoden van haar leveranciers en verwacht van hen dat ze onderzoek doen naar de herkomst en de handelsketen van conflictmineralen, dat ze op verzoek due diligence-informatie bekendmaken en dat ze mineralen inkopen uit conflictvrije bronnen die niet bijdragen aan mensenrechtenschendingen waar ook ter wereld.

Due diligence-processen voor slavernij en mensenhandel

Het proces van Otter om de relaties met de toeleveringsketen op verantwoorde wijze te beheren omvat de volgende acties:

  1. Verificatie van producttoeleveringsketens. Otter streeft naar nauwe relaties met haar leveranciers en eist dat zij voldoen aan alle aspecten van de Gedragscode, inclusief de aspecten die betrekking hebben op Moderne Slavernij.
  2. Audits van leveranciers. Otter behoudt zich het recht voor de naleving van de bedrijfsnormen en de Gedragscode door leveranciers te controleren. Otter maakt gebruik van onafhankelijke externe auditors om aangekondigde leveranciersaudits uit te voeren en te controleren of de leveranciers zich aan de regels houden. Indien Otter kennis krijgt van handelingen of omstandigheden die niet in overeenstemming zijn met de bedrijfsnormen en/of de Gedragscode, behoudt Otter zich het recht voor corrigerende maatregelen te eisen, die de beëindiging van het contract met de leverancier kunnen inhouden.
  3. Certificeringsvereisten voor directe leveranciers. Otter eist van haar Tier 1-leveranciers dat zij certificeren dat de materialen die in de producten zijn verwerkt voldoen aan de wetten met betrekking tot Moderne Slavernij van het land of de landen waarin zij zaken doen. Otter beschouwt de Gedragscode als een initiatief voor de hele toeleveringsketen en eist van leveranciers dat ze zich houden aan de wetgeving op het gebied van Moderne Slavernij. Otter eist ook van Tier 1-leveranciers dat zij de prestaties van hun toeleveranciers in de volgende tier toetsen aan de vereisten van de Gedragscode.

    Als onderdeel van de vereisten van de Gedragscode en de gespecialiseerde arbeidsnormen zijn leveranciers verplicht om passende managementsystemen te ontwikkelen, met inbegrip van beleid, procedures en bijbehorende documentatie, om te voldoen aan de vereisten en alle toepasselijke wet- en regelgeving, met inbegrip van die welke Moderne Slavernij verbieden. Otter bevestigt het bestaan en de handhaving van deze managementsystemen door middel van haar auditprogramma voor leveranciers.

  4. Interne verantwoordingsnormen en -procedures. Otter verlangt van haar medewerkers dat zij het bedrijfsbeleid naleven, met inbegrip van maar niet beperkt tot het beleid dat het gebruik van Moderne Slavernij in haar activiteiten verbiedt. Otter biedt kanalen om zorgen te melden over mogelijke schendingen van de wet of het bedrijfsbeleid, inclusief die met betrekking tot Moderne Slavernij. Otter onderzoekt dergelijke meldingen onmiddellijk en neemt alle noodzakelijke corrigerende maatregelen.
  5. Training. Personen die direct verantwoordelijk zijn voor het beheer van de toeleveringsketen moeten verplichte training volgen. Deze training biedt uitgebreide informatie over alle beleidsregels, praktijken en procedures van het bedrijf die zijn ontworpen om problemen met betrekking tot Moderne Slavernij in de toeleveringsketen te identificeren en aan te pakken en om risico's binnen de toeleveringsketen van producten te beperken.
  6. Verdere stappen

    Otter erkent dat het identificeren en beperken van de risico's van Moderne Slavernij voortdurende inzet en voortdurende verbetering vereist. Otter zal daarom blijven werken aan de inspanningen om de risico's van Moderne Slavernij binnen haar activiteiten en toeleveringsketens te identificeren, te beoordelen en aan te pakken. Deze inspanningen omvatten:

    1. Blijven werken aan bewustwording door trainingen te geven aan medewerkers en de leden van de toeleveringsketen.
    2. Onderzoek doen naar alle gevallen van niet-naleving en indien nodig onmiddellijk actie ondernemen.
    3. De effectiviteit van het beleid en de procedures van Otter monitoren.
    4. De vragenlijst voor zelfbeoordeling inzake Moderne Slavernij afnemen bij een gerichte en uitgebreide groep leveranciers via het nieuwe platform voor due diligence bij leveranciers.
    5. Wereldwijde regelgeving ter bestrijding van Moderne Slavernij blijven monitoren.

    De Raad van Bestuur van Otter Products, LLC heeft deze Verklaring, die van toepassing is op Otter Products, LLC en de aan haar gelieerde entiteiten en dochterondernemingen, goedgekeurd.
